CaleyWray at the Supreme Court of Canada

On December 8, 2009 Doug Wray and Jim Nyman appeared at the Supreme Court of Canada on behalf of the Communications Energy and Paperworkers Union of Canada in its Appeal of a Decision of the Federal Court of Appeal. The issue in Communications Energy and Paperworkers Union of Canada v. Native Child and Family Services of Toronto, SCC Docket No. 32908 is whether the labour relations of Native Child, an off reserve child and family welfare agency dedicated to Toronto’s Aboriginal community, are subject to Federal or Provincial regulation. The case was heard at the same time as a companion appeal from British Columbia that raised the same constitutional issue. The Attorney Generals of Ontario, Canada, British Columbia, Alberta, Saskatchewan, Manitoba, Quebec and New Brunswick, the Canadian Human Rights Commission, the BC Labour Relations Board, and a number of aboriginal groups and welfare agencies from across Canada all intervened in the case. The Court reserved on its decision.
