OLRB Deals with Mental Illness and Causation

The Labour Relations Board earlier found that a trade union had violated Section 74 by not properly investigating a discharge grievance before deciding to withdraw the grievance. After the discharge, the Grievor suffered from serious mental illness that rendered him unable to work for the last five and a half years and indefinitely into the future. The Grievor claimed that the Union's conduct caused his mental health issues and sought extensive compensation. The Board held that the evidence did not establish the causal link and dismissed the claim.
