Adverse Inferences to Establish Employer Initiation of Termination Applications.

In a recent decision dismissing two applications to terminate the bargaining rights of the Carpenters in the ICI and Heavy Sectors during the last open period, the Board relied on inferences and circumstantial evidence and the fact that the CLAC representative who supposedly brought the applications on behalf of the applicants and was present throughout the hearings did not testify to fill in certain critical "holes" left after the employer and applicants testified.
