Ken was successful before the Supreme Court of Nova Scotia in defending the Arbitrator's reasonable conclusion that the work required of the Grievor in yarding his train properly belonged to yard service employees. This represented a significant confirmation of the essential division of labour at terminals covered under the collective agreement.
